Welcome to Tripser. These Terms & Conditions govern your use of the Tripser mobile application and related services. By using Tripser, you agree to these Terms. If you do not agree, please do not use the service.
1. Acceptance of Terms
By accessing or using the Tripser application ("Tripser", "the Service"), you agree to be bound by these Terms & Conditions. If you do not agree to these Terms, you must not use the Service. Nothing in these Terms limits users' rights under applicable consumer protection laws.
2. Description of the Service
Tripser is a travel planning application that allows users to:
- Create and manage travel trips with multi-day itineraries
- Discover and save places and destinations
- Generate AI-powered travel itineraries, packing lists, and suggestions (on-device)
- Track travel budgets and shared expenses
- Collect digital passport stamps
- Share trips and collaborate with other users
- Communicate via direct messaging
- Navigate routes with Apple Maps integration
- Use an AI travel guide for photo analysis and translation (on-device)
- Access a companion Apple Watch app
Certain features may require a paid subscription called Tripser Pro. Features and functionality may change or evolve over time. AI features require a device that supports Apple Intelligence.
3. User Accounts
To use certain features, you may be required to create a user account. You agree to:
- Provide accurate and complete information
- Maintain the confidentiality of your login credentials
- Be responsible for all activity that occurs under your account
You must be at least 13 years old to use the Service. If you are under the age required by applicable law to consent to data processing, parental or guardian consent may be required. Tripser reserves the right to suspend or terminate accounts that violate these Terms.
4. User Content
Users may create, upload, or share content such as travel notes, photos, reviews, itineraries, and location information. You retain ownership of the content you submit.
However, by submitting content to Tripser you grant Tripser a non-exclusive, worldwide, royalty-free license to display, host, reproduce, distribute, and promote such content within the Service and for promotional purposes related to the Service.
Users must not upload content that violates laws, infringes intellectual property rights, or contains harmful, abusive, or illegal material. Tripser reserves the right to remove, moderate, or restrict user content at its discretion.
5. Subscriptions & Payments
Tripser offers optional premium features through Tripser Pro. Subscriptions may be offered on a:
- Weekly basis ($1.99 USD / week)
- Monthly basis ($4.99 USD / month)
- Yearly basis ($49.99 USD / year)
Prices shown are in USD and may vary by region. Payment will be charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
Users can manage or cancel subscriptions in their Apple ID account settings. Free trials, if offered, automatically convert into paid subscriptions unless canceled before the trial period ends.
6. AI-Powered Features
Tripser provides AI-powered travel assistance using Apple Intelligence, processed entirely on your device. AI features include itinerary generation, travel suggestions, packing lists, photo analysis, and translation. AI-generated content:
- Is processed on-device and does not send your data to external AI services
- May be incomplete or contain inaccuracies
- Should not be relied upon as professional travel, legal, visa, medical, or safety advice
- Requires a device that supports Apple Intelligence (availability varies by device and region)
Travel conditions, visa requirements, health regulations, and safety information may change frequently. Users are responsible for independently verifying important information through official sources. Tripser is not liable for decisions made based on AI-generated suggestions.
7. Location Services
Some features of the Service require access to your device location. Location services can be enabled or disabled at any time through your device settings. Disabling location services may limit certain functionality of the application.
8. Personal Data & Privacy
Tripser processes personal data in accordance with applicable data protection laws. Tripser may process information such as:
- Account details
- Travel information
- Location data
- User-generated content
Details about how personal data is collected, processed, and stored are described in the Tripser Privacy Policy.
9. Third-Party Services
Tripser integrates services provided by third parties, including but not limited to:
- Apple MapKit (maps and navigation)
- Apple Intelligence (on-device AI processing)
- Firebase by Google (authentication, database, storage, push notifications)
- OpenWeatherMap (weather forecasts)
- Apple Sign-In (authentication)
- Google Sign-In (optional authentication method)
- Frankfurter (currency exchange rates)
Use of these third-party services is subject to their respective terms of service and privacy policies. Tripser is not responsible for the functionality, policies, or practices of third-party services.
10. Usage Limits
To ensure fair use and service stability, Tripser applies reasonable daily usage limits on certain actions, including but not limited to messaging, trip creation, photo uploads, social interactions, and search queries. These limits reset daily and are designed to accommodate normal usage patterns. If a daily limit is reached, the action will be temporarily unavailable until the following day.
11. Direct Messaging
Tripser provides direct messaging between users. Users agree not to use messaging for spam, harassment, solicitation, or distribution of harmful content. Tripser reserves the right to monitor, moderate, or restrict messaging functionality to maintain a safe environment. Message content is stored in Firebase and is accessible to conversation participants only.
12. Prohibited Conduct
Users agree not to:
- Use the Service for unlawful purposes
- Attempt unauthorized access to systems or accounts
- Interfere with the application's infrastructure
- Scrape or collect data from the Service without authorization
- Create abusive or duplicate accounts
- Impersonate others
- Use automated systems or bots to access the Service without permission
- Attempt to circumvent daily usage limits
- Send spam, unsolicited messages, or harassing content
Violation of these rules may result in account suspension or termination.
13. Intellectual Property
All intellectual property related to the Service, including:
- Application design
- Software code
- Branding
- Logos
- Features
is owned by Tripser or its licensors and protected by applicable copyright and intellectual property laws. Users may not reproduce, distribute, or modify any part of the Service without permission.
14. Disclaimer of Warranties
The Service is provided "as is" and "as available." Tripser makes no warranties regarding:
- Uninterrupted availability
- Accuracy of travel information
- Reliability of third-party services
- Completeness of AI-generated content
Travel information may change without notice.
15. Limitation of Liability
To the maximum extent permitted by applicable law, Tripser shall not be liable for:
- Indirect damages
- Consequential damages
- Loss of profits
- Loss of data
- Travel disruptions resulting from inaccurate information
Tripser's total liability arising from the use of the Service shall not exceed the amount paid by the user to Tripser within the preceding 12 months.
16. Termination
Tripser may suspend or terminate user accounts if users:
- Violate these Terms
- Misuse the Service
- Engage in prohibited conduct
Users may stop using the Service at any time.
17. Changes to Terms
Tripser may update these Terms periodically. Material changes will be communicated within the app or through other appropriate channels. Continued use of the Service after such updates constitutes acceptance of the revised Terms.
18. Governing Law
These Terms shall be governed by the laws applicable in the jurisdiction where Tripser operates, without prejudice to mandatory consumer protection laws applicable to users. Any disputes arising from the use of the Service may be resolved through competent courts.
