Welcome to Tripser. These Terms & Conditions govern your use of the Tripser mobile application and related services. By using Tripser, you agree to these Terms. If you do not agree, please do not use the service.

1. Acceptance of Terms

By accessing or using the Tripser application ("Tripser", "the Service"), you agree to be bound by these Terms & Conditions. If you do not agree to these Terms, you must not use the Service. Nothing in these Terms limits users' rights under applicable consumer protection laws.

2. Description of the Service

4. User Content

Users may create, upload, or share content such as travel notes, photos, reviews, itineraries, and location information. You retain ownership of the content you submit.

However, by submitting content to Tripser you grant Tripser a non-exclusive, worldwide, royalty-free license to display, host, reproduce, distribute, and promote such content within the Service and for promotional purposes related to the Service.

Users must not upload content that violates laws, infringes intellectual property rights, or contains harmful, abusive, or illegal material.

Tripser has zero tolerance for objectionable content and abusive users. You must not post, send or share anything hateful, harassing, threatening, sexually explicit, violent or otherwise objectionable, whether in a trip, a journal, a comment, a message, a photo, a name or a username.

Anyone can report content or another user from inside the app, and block users they do not want to see or hear from. Reports are reviewed within 24 hours. Content that breaks these Terms is removed, and the accounts that post it are suspended or terminated.

Tripser filters some words automatically. The filter does not catch everything, and content that passes it is not thereby acceptable.

Tripser reserves the right to remove, moderate, or restrict user content at its discretion.

5. Subscriptions & Payments

Tripser offers optional premium features through Tripser Pro. Subscriptions may be offered on a:

Prices shown are in USD and may vary by region. Payment will be charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.

Users can manage or cancel subscriptions in their Apple ID account settings. Free trials, if offered, automatically convert into paid subscriptions unless canceled before the trial period ends.

6. AI-Powered Features

Tripser provides AI-powered travel assistance using Google Gemini, processed on Google's servers, not on your device. AI features include itinerary generation, travel suggestions, packing lists, photo and receipt reading, booking import, and trips created from videos. They work only after you allow them, and you can turn them off at any time in the app's Settings, under AI & Your Data.

When you use an AI feature, only the data that feature needs is sent to Google Gemini, as AI & Your Data lists. Your messages, and anything else a feature does not need, are never sent to it.

AI-generated content:

Travel conditions, visa requirements, health regulations, and safety information may change frequently. Users are responsible for independently verifying important information through official sources. Tripser is not liable for decisions made based on AI-generated suggestions.

7. Location Services

Some features of the Service require access to your device location. Location services can be enabled or disabled at any time through your device settings. Disabling location services may limit certain functionality of the application.

8. Personal Data & Privacy

Tripser processes personal data in accordance with applicable data protection laws. Tripser may process information such as:

Tripser stores this data with Firebase, a cloud service operated by Google, so that it is available on your devices and to the people you share it with. Google encrypts it in transit and at rest. Keeping data in Firebase does not send it to Google Gemini: AI features receive only what section 6 describes.

9. Third-Party Services

Tripser integrates services provided by third parties, including but not limited to:

Use of these third-party services is subject to their respective terms of service and privacy policies. Tripser is not responsible for the functionality, policies, or practices of third-party services.

10. Usage Limits

To keep Tripser fair and reliable, some features have usage limits.

Monthly limits apply to features that rely on paid services: AI features (itineraries, Discover suggestions, the AI Guide, receipt scanning, booking and video import, pack lists, pros and cons, and nearby suggestions), place photos, and flight searches and flight lookups. Event searches have a monthly limit for every account. Monthly limits reset on the 1st of each month (UTC) and are set well above normal use. During a free trial, each of these limits is a quarter of the monthly limit, and at least one; event searches are the same for every account. The current limits are listed at tripser.ai/limits. Limits may change; that page always shows the current ones. When you reach a limit, Tripser tells you what ran out and when it comes back.

Tripser also applies reasonable daily limits on certain actions, including messaging, trip creation, photo uploads, social interactions, and search queries. If a daily limit is reached, the action is unavailable until the following day.

11. Direct Messaging

Tripser provides direct messaging between users. Users agree not to use messaging for spam, harassment, solicitation, or distribution of harmful content. Tripser may moderate or restrict messaging to keep the Service safe.

Messages are stored with Firebase so they can be delivered and kept in sync across your devices. In the app, only the people in a conversation can read it. Messages are not end-to-end encrypted: when a conversation is reported, Tripser reviews it to enforce these Terms, and Tripser may disclose messages where the law requires.

Messages are never sent to Google Gemini or used by AI features.

All intellectual property related to the Service, including:

14. Disclaimer of Warranties

The Service is provided "as is" and "as available." Tripser makes no warranties regarding:

15. Limitation of Liability

To the maximum extent permitted by applicable law, Tripser shall not be liable for:

Tripser may update these Terms periodically. Material changes will be communicated within the app or through other appropriate channels. Continued use of the Service after such updates constitutes acceptance of the revised Terms.

18. Governing Law

These Terms shall be governed by the laws applicable in the jurisdiction where Tripser operates, without prejudice to mandatory consumer protection laws applicable to users. Any disputes arising from the use of the Service may be resolved through competent courts.
